2. Definitions

• Business Day: Calendar day, excluding Saturdays, Sundays, and Dutch public holidays, when banks in the Netherlands are open.
• Consumer: Natural person not acting in the course of a profession or business, entering into an Agreement with Cayir Watches via the Cayir Watches Webshop.
• Agreement: Any agreement for orders placed for Products on the Cayir Watches Webshop.
• DCC: Dutch Civil Code (Burgerlijk Wetboek).
• Durable Medium: Instrument, including email, allowing the Consumer to store information for future reference.

3. Applicability
3.1. These General Terms and Conditions apply to any Agreement for the sale and delivery of Products through the Cayir Watches Webshop. They also apply to all quotations, offers, acceptances, acknowledgments, and confirmations by Cayir Watches.
3.2. By placing an order, the Consumer agrees to be bound by these General Terms and Conditions.
3.3. In case of specific Product-related terms, the Consumer may invoke the most favorable condition in case of contradictory terms.
3.4. These General Terms and Conditions supersede any previous terms for the sale and delivery of Products through the Cayir Watches Webshop.

4. Offers and Orders
4.1. Material on the Cayir Watches Website is for general information. Obvious errors in the offer do not bind Cayir Watches.
4.2. Limited duration offers will be indicated on the Cayir Watches Website.
4.3. An offer is subject to availability. Cayir Watches may cancel an order if a Product is out of stock, with email notification to the Consumer.

5. The Agreement
5.1. The Agreement becomes effective upon acceptance of an offer by the Consumer through the Cayir Watches Webshop. Cayir Watches sends an automated email confirming the receipt of the order.
5.2. Cayir Watches may reject or cancel an order in specific situations, with email notification to the Consumer.

6. Prices

• All prices on the Cayir Watches Website are in Euros and include VAT.
• Prices may change without notice. Shipping and delivery rates are applied per order, with additional costs borne by the Consumer.

7. Right of Withdrawal
7.1. The Consumer has the right to withdraw from the Agreement within 14 calendar days. This includes the option to dissolve the agreement, receive a refund, or exchange the ordered Product.
7.2. Products unsuitable for return due to health or hygiene reasons cannot be returned or exchanged.
7.3. To exercise the right of withdrawal, the Consumer must inform Cayir Watches within the specified period, either through the Cayir Watches Website or by email to yekta@cayirwatches.com.
7.4. The Consumer must return the Product within 14 calendar days in its original state. Return costs will be deducted from the refund.

8. Payment by the Consumer
8.1. Sums payable to Cayir Watches must be paid by the Consumer within 14 calendar days after the Agreement.
8.2. Only payment methods indicated on the Cayir Watches Website are accepted. Actual payment costs are passed on to the Consumer.
8.3. The Consumer must inform Cayir Watches of any payment data inaccuracies.

9. Shipping and Delivery
9.1. The ordered Product will be shipped within 1-3 Business Days. Shipping and delivery terms are indicative, and Cayir Watches is not liable for delays.
9.2. Cayir Watches ships to specified countries. The Consumer is responsible for lawful importation if the shipping address is outside the European Union.
9.3. Cayir Watches retains ownership until full payment. Risks pass to the Consumer upon delivery.

10. Complaints
10.1. The Consumer can rely on the legal guarantee of conformity of goods. Complaints about defects or non-compliance must be sent to yekta@cayirwatches.com within a reasonable time, but no later than two (2) months after discovery.
10.2. Complaints will be replied to within five (5) Business Days. The Consumer must assist Cayir Watches in examining the complaint.
10.3. In case of a justified complaint, the Consumer is entitled to replacement, repair, or an appropriate credit for the purchase price.
10.4. The Consumer must return the defective Product to Cayir Watches. The defective Product becomes Cayir Watches' property after replacement or credit.

11. Liability
11.1. Cayir Watches shall not be liable for indirect loss or damage unless caused by intent or willful recklessness.
11.2. Aggregate liability of Cayir Watches to the Consumer shall not exceed the invoice value of the Product unless damages are caused by intent or willful recklessness.

12. Intellectual Property Rights
12.1. All Intellectual Property Rights remain the exclusive property of Cayir Watches or its licensors.
12.2. The Consumer shall not copy Products or the Cayir Watches Website without prior written approval.
12.3. No license or rights regarding Intellectual Property Rights are conferred to the Consumer.

13. Privacy
Cayir Watches processes personal details in accordance with the Privacy Policy on the Cayir Watches Website.

14. Availability of the Cayir Watches Webshop
Cayir Watches does not guarantee uninterrupted availability of the Cayir Watches Website and reserves the right to alter or discontinue it without notice.

15. Miscellaneous
15.1. The invalidity or unenforceability of any provision in these General Terms and Conditions does not affect the validity of other provisions. An invalid or unenforceable provision shall be replaced by a valid and enforceable one.
15.2. Cayir Watches reserves the right to unilaterally amend these General Terms and Conditions. Amendments will be notified on the Cayir Watches Website.

16. Governing Law and Jurisdiction
16.1. These General Terms and Conditions and any Agreement are exclusively governed by and construed in accordance with the laws of the Netherlands, excluding any conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods.
16.2. The competent court in the Netherlands shall have exclusive jurisdiction to settle any dispute arising from these General Terms and Conditions and/or any Agreement.
